Bankruptcy Bill Update

Are the Bankruptcy Laws going to change?
As of this writing, 10/16/05 at 9:30 pm PDT, it pains this office to state the answer is "yes". The laws change substantially tonight, at 12 mid-night, 10/17/05.

So, I missed the deadline, this means I can't file bankruptcy, right?
WRONG! While these are very dangerous times, bankruptcy as a form of relief still exists. The credit industry has invested many many millions of dollars to buy and pay for this unfair Bankruptcy bill change. They have lobbied continuously over these past 8 years, and they have been successful. The myriad of changes are all pro-creditor and all anti-debtor. The bill does nothing more than create hurdle after hurdle in the form of added paperwork, time and cost to prevent many many Americans from getting the fresh start they will need to support our credit driven economy. The bill, in many respects takes away the hope of substantial financial rehabilitation, on the false premise that most American's who file for bankruptcy do so willingly, purposefully, and without any personal moral or financial pain.

So, what should I do?
Watch this space. Examine your options whether to file. If you wonder if you should file bankruptcy, call our office for a free consultation. We are aware that many do not want to face or admit failure when it comes to money problems. The thought of filing bankruptcy is abhorant to most. You should know that you are not alone. In our view, a fresh start is still possible under the new laws, and if used judiciously and intelligently, even the new laws can be very beneficial. Please choose to come in and at least examine your options. The office consultation is free and without obligation.
